Accountability
DKE’s policy on internal accountability is listed below:
- As stated below, DKE will not tolerate sexual misconduct in any form. If any suspicious, ambiguous, or obvious sexual misconduct is seen by any brother, then that brother has the responsibility to intervene as soon as possible and report said misconduct to the President, Vice President of Risk Management, and the appropriate authorities.
- Any person, including non-brothers, may report an incident or suspected misconduct by the Chapter or Member of the Fraternity to either the international fraternity or the Delta Delta Chapter. This may be done through the corresponding website located at dke.org or directly below.
- Any brother accused of sexual misconduct shall be immediately suspended from all chapter activities, including but not limited to parties and chapter meetings. If the accused brother lives in the DKE house, they shall be asked to vacate the premises until such a time that a Judicial Committee (in line with the constitution of the Delta Delta chapter), the University, or a Court of Law reaches a verdict on the situation. A decision by a Court of Law or the University shall supersede any decision reached by the internal Delta Delta Judicial Committee.
- A Judicial Committee shall be made up of 5 upperclassmen and shall hear all the available facts surrounding the case, including any desired attestations/other submissions by witnesses and/or victims, before coming to a verdict, including a recommended sentence that shall be executed by the chapter President.
- Any and all legal means to evict an accused brother from the fraternity house until a verdict has been reached will be used if the accused brother does not vacate the house of their own volition.
- Once a Judicial Committee reaches a verdict, their recommended sentence shall be executed by the President in line with the Delta Delta Constitution and the International Fraternity Constitution. If a guilty verdict is reached, then the accused brother shall be expelled from the chapter and fraternity in line with the Delta Delta Constitution and the bylaws of Delta Kappa Epsilon International Fraternity.
- Any verdict by the University, international fraternity, or Court of Law, as stated above, shall supersede the verdict of the Judicial Committee; however, a not-guilty verdict reached by the aforementioned authorities is a requisite, but not solely sufficient, reason for reinstatement to brotherhood of the Delta Delta chapter and Delta Kappa Epsilon International Fraternity. At the release of the verdict, the Judicial Committee shall be reconvened, and an appropriate action will be recommended and executed by the chapter President with regard to reinstatement.
- Any decision made by the Judicial Committee, once all higher authorities have made their final verdicts, is final, and there shall be no appeal process.
Our Statement on Sexual Misconduct
To date, the Delta Delta Chapter has had zero Title IX reports and no recorded instances of misconduct related to the chapter. The brothers of DKE hold themselves to a standard of making our space safe and enjoyable for every one of our guests. In order to support a fun and social environment, we must first guarantee a safe environment. The brothers of DKE take instances of misconduct, sexual or otherwise, very seriously. We want our guests to know that they always have the right to feel safe in our house.
The Delta Delta Chapter of DKE will not tolerate sexual misconduct in any form. Sexual misconduct incorporates a range of behaviors as defined by Illinois and Federal law, including sexual assault, sexual harassment, intimate partner violence, stalking, voyeurism, and any other conduct of a sexual nature that is non-consensual, and/or has the purpose or effect of threatening, intimidating, or coercing a person. Title IV of the University’s Policy on Unlawful Discrimination and Sexual Misconduct provides the following definition: “Sexual misconduct encompasses a range of conduct, from sexual assault (a criminal act that the U.S. Department of Education defines as sexual harassment) to conduct such as unwanted touching or persistent unwelcome comments, e-mails, or pictures of an insulting or degrading sexual nature, which may constitute harassment, depending upon the specific circumstances and context in which the conduct occurs. For example, sexual advances, requests for sexual favors, or sexually-directed remarks or behavior constitute sexual harassment when (i) submission to or rejection of such conduct is made, explicitly or implicitly, a basis for an academic or employment decision, or a term or condition of either; or (ii) such conduct directed against an individual persists despite its rejection.”
The Brothers of DKE recognize the necessity and primacy of affirmative consent. Sexual misconduct is as such defined by DKE as any sexual behavior that is not subject to explicit, conscious, and voluntary agreement to engage in by all involved parties.
